This week, NVAC filed two National Grievances over the Department’s continued exclusion of the Union from local committees (NG-10/20/2025, VA CBA Termination 7.0—Committee Removals) and New Employee Orientation (NG-10/21/2025, VA CBA Termination 8.0—New Employee Orientation Exclusion). Union participation in both New Employee Orientation (“NEO”) and various VA committees were negotiated at the national level and are covered by the Master Agreement.
Following the Department’s unlawful August 6 termination of the CBA, the Department began removing Locals from VA committees and barring them from participating in NEO, despite the MCBA’s requirements that the Union would have the ability to participate in these processes and at times, in the case of local committees, in violation of additional Local Supplemental Agreements and/or committee bylaws. The Department did so even for committees and NEOs covering Exempted Employees (police officers, firefighters, and security guards), which the Department claims are still covered by the MCBA and Statute. AFGE continues to litigate the Trump Administration’s unlawful Exclusions Order. The National Grievances assert that the Department’s actions have violated and continue to violate Articles 2, 3, 8, 18, 29, 37, 47, and 49 of the MCBA and committed several unfair labor practices in violation of 5 U.S.C. §7116(a).
