On July 19, 2013, NVAC filed a National Grievance concerning the Agency’s failure to pay certain premium pay (i.e., night shift differential and weekend premium pay) to eligible hybrid Title 38 employees while on authorized paid leave. 

We are pleased to report that NVAC has settled NG-7/19/13.  Pursuant to the attached Settlement Agreement, the Agency has agreed to a claims submission process.  Claims will first be reviewed by the employee’s Local Payroll Office and then by the VA Financial Services Center. 

A copy of the required Claim Form is attached to the Settlement Agreement.  Eligible HT38 BUEs are defined in paragraph 3 of the Settlement Agreement and have 90 calendar days (until December 28, 2020) to submit their claim(s) to the Agency.  The claim period covers July 1, 2012 through September 29, 2020.  Eligible HT38 BUEs will receive backpay and interest. 
 

The NVAC Legal Team will be distributing comprehensive guidance shortly.  This guidance will include a sample Claim Form.
