In September 2019, the VA implemented a change to the leave policy contained in VA Handbook 5011 that adversely impacted certain full-time physicians, chiropractors, dentists, optometrists, and podiatrists (collectively “Physicians”). On January 4, 2021, NVAC distributed a President’s Briefing summarizing the arbitration award sustaining our National Grievance – 10/9/19. A copy of that President’s Briefing is attached for reference. The VA failed to comply with the deadlines contained in the arbitration award. NVAC shares the frustration of Locals and Physicians across the country who have been waiting for the VA to restore this leave since September 2019.
On April 27, 2021, NVAC and VA executed a settlement agreement outlining the procedures that VA must follow when implementing and complying with the arbitration award. The agreement addresses the procedures to be followed in “making-whole” all current, separated, and retired Physicians impacted by this case. It also contains a copy of the signed notice posting acknowledging the VA’s unfair labor practice in this case, which will be emailed to AFGE bargaining unit employees. The VA must complete all obligations under the agreement within 45 days, or by June 11, 2021.
